Furthermore, RDC No. 660/2022 stipulates that patients must register with Anvisa through the electronic form for the importation and use of cannabis-derived products, available on the Federal Government’s Service Portal.
Applicable Law - Export to Brazil - Resolution RDC No. 660, March 30, 2022:
Article 14: The approval of registration, whether simplified or automatic, does not prevent the health authority from suspending the importation and use of imported products under this resolution at any time, based on technically justified criteria or indications of irregularity, as well as taking other measures deemed appropriate according to current legislation.
Article 15: Changing the purpose of this importation is prohibited; the use of the imported product is strictly personal and non-transferable, and its delivery to third parties, donation, sale, or any other use different from that indicated is forbidden.
Article 16: The importer is obligated to observe and comply with legal provisions regarding the prohibition of marketing, delivery to third parties, or sale of imported products.
Article 17: The responsibility for damages to individual or collective health and the environment arising from changing the purpose of entry of the product into the national territory lies with the importer.
Article 18: The prescription made by the professional and the request for authorization by the patient or their legal representative represent the acknowledgment and acceptance by both parties of the lack of proof of quality, safety, and efficacy of the imported products, as well as any adverse events that may occur, with the prescribing professional and the patient or their legal representative being fully responsible for the use of the product.
