According to ANVISA’s regulatory guidelines, the provisions of the Consumer Protection Code (CDC) do not apply to cannabis-based products. Therefore, the right of withdrawal (Article 43, CDC) and the cancellation of the purchase within 7 days of receiving the product do NOT apply.
RDC No. 660/22 from ANVISA defines the use of cannabis-derived products that are not regulated in the country as strictly personal and non-transferable. While it does not mention returns, it prohibits delivery to third parties, donations, sales, or any other use other than what is specified.
Similarly, RDC No. 471/21 from ANVISA, particularly in Article 21, applies subsidiarily to situations regarding the return of cannabis-based products and prohibits individuals from returning such controlled medications. However, it does address concerns for patients regarding various issues, such as damaged packaging and expiration dates.
